Who Is Eligible for VA Burial Benefits?

VA burial benefits are available to veterans who meet all of the following eligibility criteria:

  • Discharge status — The veteran must have been discharged under conditions other than dishonorable. This is the primary eligibility requirement.
  • Minimum active service — For veterans who entered active duty after September 7, 1980, a minimum of 24 months of continuous active duty is generally required, or service for the full period for which they were called to active duty.
  • Service-connected death — Veterans who died from a service-connected disability are eligible for the higher benefit amounts regardless of length of service.
  • VA pension or compensation recipients — Veterans receiving VA pension or compensation at the time of death are also eligible.
  • Dole Act expansion (July 2025 to October 2026) — Under the Senator Elizabeth Dole 21st Century Veterans Healthcare and Benefits Improvement Act, veterans discharged from VA medical or nursing care to receive VA-provided hospice care at home who pass away between July 1, 2025, and October 1, 2026, are temporarily eligible for the full VA burial allowance — closing a previous gap for hospice patients who passed at home.
  • Spouses and dependents — Spouses and eligible dependents of veterans may be buried in a national cemetery alongside the veteran at no cost. The VA does not pay a separate burial allowance for spouses or dependents.

Does the VA Pay for Cremation?

Yes. The VA burial allowance applies to cremation, not just traditional burial. Veterans who choose cremation, including traditional flame cremation or aqua cremation, are eligible for the same burial allowance as veterans who choose ground burial.

If cremated remains are interred at a VA national cemetery, there is no cost for the gravesite, opening, perpetual care, niche in a columbarium, or a government marker. If cremated remains are scattered or kept rather than interred in a national cemetery, the $1,002 plot allowance does not apply, but the $1,002 burial and funeral allowance still applies.

The type of cremation does not affect eligibility. Veterans who choose aqua cremation receive the same VA benefits as those who choose traditional flame cremation.

What Are Military Funeral Honors?

Military funeral honors are a separate benefit from burial allowances, and they cost the family nothing. Under the Veterans Benefits Improvement Act, any veteran who served in the military and was discharged under other than dishonorable conditions is entitled to military funeral honors at no cost upon request.

At minimum, military funeral honors include:

  • Folding and presentation of the American flag to the next of kin
  • The playing of Taps — either live or by recording

For veterans with branch-specific eligibility, additional honors may include a rifle salute (three volleys), active duty military pallbearers, and an official military escort.

How to Apply for VA Burial Benefits — Step by Step

Gather discharge documentation

The DD Form 214 (Certificate of Release or Discharge from Active Duty) is the primary document needed. If unavailable, it can be requested from the National Archives through the eVetRecs system at archives.gov.

Obtain certified death certificates

For non-service-connected deaths, the claim must be filed within two years of permanent burial or cremation. For service-connected deaths, there is no time limit.
